Auction Zone Web Site Terms & Conditions of Use
It is the goal of Auction Zone to provide its users/members a pleasant and safe place to buy and sell items online.
To use this site you must agree to all the terms and conditions listed within this 'Terms & Conditions' page before registering to buy or sell any merchandise on this auction site.
Users/members who engage the use of Auction Zone shall not in any way involve themselves in any scamming, fraud, dishonesty or other illegal activities as according to the law of both Australia, all its states and International Laws. Persons who do engage in illegal activities will be terminated from using this site and may be subject to criminal prosecution.
Membership Eligibility - You must be at least 18 years of age to use this site. 18 years of age is an age where you are able to create legally binding contracts. If you are under 18 years of age, you will need to ask a guardian to signup, and buy and sell on your behalf.
Auction Services - Auction Zone is in the business of providing a service for parties to trade between themselves, we only provide services to people interested in selling and buying merchandise via internet auction. We may also at times sell our own merchandise on the site. Note that we do not have control of what is posted on this auction site, therefore do not guarantee any quality or authenticity of any items listed for sale. It is important to note that Auction Zone is not in anyway responsible or liable for the actions that both buyers and sellers take before, during and after the auction, including typographical errors, misprints, loss of merchandise and/or money, loss of data, damage or failure of equipment both yours and/or Auction Zones, due to a visit or transaction at this auction site.
The use of this auction site is at your own risk. Auction Zone is not responsible for any issues arising out of your usage of the site, no matter what the concern.
Buying, Bidding and Selling - As a user, you may buy, bid or sell merchandise on Auction Zone as you please.
Bidding - Note that once you make a bid it is a binding contract by law, between you and the seller. The bid cannot be retracted unless the seller permits it to be retracted, or unless there is clear evidence of a typographical or other error on the seller's part that deems the item for sale as not appropriately described.
If you place a bid then win the auction you are obliged to pay for the item as instructed by the seller.
It is illegal to place bids on items and not pay for them if you win. As already stated, a winning bid is a contractual binding agreement between the buyer and seller.
Seller - the items that you list for sale must be available. If a bid has been placed on an item you have listed for sale, you have entered into a legally binding contract with the buyer. The only way to retract the sale, is with agreement with the buyer to do so.
Reserve Price - Once an auction is over, if the reservce price has not been met then no contractual agreement exists and you are not obliged to sell the item. However if the reserve price is met, then both the buyer and seller have a contractual agreement.
All fee charges, referral payment structures and associated fee structures throughout Auction Zone are subject to change without notice. All fees charged in Auction Zone are inclusive of GST (Goods and Services Tax) unless otherwise stated.
Sellers are not allowed to bid on their own items or encourage friends/family to bid on sellers item to push price upwards.
Listing Items - As a user/member you are entitled to list as many items on Auction Zone for sale as you wish. You are not to sell any illegal merchandise, or anything that is affiliated with pornography, pirated music and software, firearms, adult video's or anything else deemed illegal in Australia.
Review of Items - It is at the discretion of the Auction Zone staff to remove any items listed that are deemed to be inappropriate without any prior warning to the seller/bidder.
Do not include an email address, telephone number or website address in your item listing. Auction Zone is entitled to send to a Seller the details of the winning bidder(s). Also the Winning bidders are allowed to receive from Auction Zone the details of the Seller. Details may include, Username, users real name, phone number, mobile number (if it has been listed), address and email account. This allows for open and honest trading.
Charges and Fees - Any fees that are applicable when listing an item on Auction Zone are payable to Auction Zone when users/members are invoiced for payment. Likewise, any fees applicable for selling an item on Auction Zone are payable to Auction Zone when users/members are invoiced for payment. Payments should be made with 14 days of the invoice date. Any user who does not make payment within 28 days will have their account suspended and legal proceedings may occur for monies owing.
Any commissions paid from Auction Zone to users/members are done at the discretion of Auction Zone. Note that commissions will be applied against a user/member account balance. Commissions will only be paid out directly to users/members when they have a minimum account balance of $15 and they request payment to Auction Zone. A $2.20 processing fee will be charged for sending a cheque for this commission to be posted out to user/members address. No fee will be charged for making a direct account deposit.
Privacy - Personal information about you is not sold, rented, or used in any way without your permission. Your information is however shared to a a user/member who wins an auction of yours, or to any seller in which you have won an item they are selling, this information is used for the purpose of being able to exchange items and money effectively and for open honest trading.
Personal information sent to a user regarding a product bought or sold on this auction site is not to be used for any other purpose, except for communication about the auction item transaction.
Warranty - Auction Zone provides this website without any warranty or condition. Auction Zone is not liable for any damages resulting from an auction, or any actions performed through this site.
Service Conditions - Auction Zone acts only as a provider of a place for both buyers and sellers to buy and sell legal merchandise. Auction Zone does not have control over any quality, usability, legality, etc of the merchandise on offer at this auction site. Auction Zone provides this website without a warranty of any kind. Auction Zone is not in any way liable for damages resulting from an auction, transaction, situation, visit or any other action on this site. Auction Zone is not responsible or liable for any damages caused or alleged to of been caused directly, indirectly, incidentally, or consequentially by anything on or related to this auction site.
Auction Zone will not get involved in any disputes between its users. In the case of a dispute, by registering on this site, you are releasing any liability from Auction Zone and its parent company Sykes Technology P/L and its agents, employees, and assignees, and any affiliated companies or individuals from any claims, suspected and unsuspected, whether disclosed or undisclosed, arising out of, or in any way connected to, any disputes. We suggest and expect that users will use common sense and good business practices and personal courtesy to avoid disputes. If another user has a complaint with you, please establish a polite dialog with him or her to resolve the dispute to mutual satisfaction. Above all, when buying something from someone whether on the internet or anywhere else, your best protection is to be an informed buyer.
We cannot, and will not, be held responsible for any interruption to service, caused by any means. We apologise for any inconvenience during any downtime if and when it occurs.
We reserve the right to remove any user from this auction site at any time for any reason we deem sufficient and without explanation required.
We will tolerate no violations of law or regulations by any actions, especially those that are libellous, threatening, harassing, or obscene.
Your use of this auction site indicates your acceptance of these Terms and Conditions.
